Using the example of Fausty offering Fighting is Magic orignal characters, if these characters where not found in the show, their names did not match any of the ones in the show, and they did not originate from show-related places: would that be fair lands? For example an OC who doesn't come from Equestria, is an Pegasus, and is named Flargal, is this fair grounds? Or does it still mess with the laws of IP?
