It's a naturalization act. Naturalization is the conferring of citizenship upon an alien. It says that aliens shall be considered as citizens or natural born citizens, therefor they must not be citizens or natural born citizens until this act confers that legal status on them.

It creates a legal fiction, taking what are in fact aliens and granting them a legal status. They aren't really citizens or natural born citizens, but they made to be so "in the eyes of the law"

The Framers in Article II distinguished between a "citizen" and a "natural born citizen". The first Congress, many members of which were Framers, in the Naturalization Act of 1790 distinguished between a "citizen" and a "natural born citizen".

In the Naturalization Act of 1790 the distinguishing characteristic between persons naturalized with a status of "citizen" and those naturalized with a status of "natural born citizen" is their US citizen parents.

Congress in the Naturalization Act of 1795, et seq, no longer made such a distinction and declared all such persons naturalized to be "citizen". Are we to conclude that subsequent to 1795 there were no further "natural born citizens"? They ceased to exist?

Or are we to conclude that the other children born to US citizen parents - those who were not "born beyond Sea, or out of the limits of the United States" - those born within the United States - are "natural born citizens"?

Of course the only rational conclusion is that those born to US citizen parents within the United States are "natural born citizens", and all others are not.

The 1790 Act et seq. also demonstrates that the foreign-born children of citizens have always required naturalization. The 1790 Act provided a legal fiction that some naturalized persons be "considered as" natural born citizens, not that they are natural born citizens.

The 1790 Act proves who the "natural born citizens" are and proves Cruz is not eligible.

Levin's false framing of eligibility requirements:

* These kooks and birthers claim Cruz is not a citizen

* Anybody who is a citizen... a natural... a naturalized, ...a naturalized born citizen is eligible (he confused a caller with his deliberate stammering confounding jumble on Tuesday night)

* The Republican establishment is behind this "attack". McConnell said they will not pass a resolution as they did for McCain. The Senate resolution is meaningless, Levin surely knows this, yet since they won't pass a resolution for Cruz it's the Republicans who are attacking Cruz. This is what Levin said on Tuesday, by Wednesday it was leftists who where attacking Cruz.

As deplorable as his deliberate deceptions are he went further. He then wrapped himself in the flag and said that "birthers" claim foreign-born service members are not citizens. This is not only a lie, it is despicable and divisive.

Levin is no different than Obama. He uses the same "citizen at birth" lie and he turns people against each other.

Many people do have reading comprehension problems. They insert or remove words willy-nilly and then claim phrases are identical. They either can not read or are liars.

We need to know when his father became a Canadian citizen to help rule out any possibility thnat the mother also became a Canadian citizen. It may be that Cruz is not eligible to be a U.S. Senator.
