But when I read the rest of the article, as well as the articles in the hyperlinks, I can't find proof of any specific unlawful or harmful acts that the judge allegedly committed. I also note a factual error in AP writer Michael J. Crumb's article. The prosecutors, not the judge, dismissed the immigration charges against Rubashkin. Rubashkin's legal team have asked for a new trial under US Code - Section 455(a): Disqualification of justice, judge, or magistrate judge. This section states: "(a) Any justice, judge, or magistrate judge of the United States shall disqualify himself in any proceeding in which his impartiality might reasonably be questioned." In the spirit of this section of the USC, this article, and the earlier one by Bob Barr about Rubashkin, should be removed. I do not believe the articles were written by impartial persons.
