Now again, shite happens, like objects in the road that fall off other cars, pedestrians, other inattentive drivers... but what point i am trying to make is if you have an accident because its snowing out... its DRIVER ERROR!!!!! period.
Im was not talking about anything except wether related accidents... read my posts all the way through and you will get the WHOLE POINT. :)

EVERY SINGLE OTHER CASE, and yes ALL of them, are driver error. Period. You lost control? driving too fast for road, conditions, traffic, your vehicle is in bad repair etc. even if ur NOT SPEEDING (going over the posted limit)... if you cant control your car, you are by law SPEEDING (going too fast for conditions) and you are at fault.

Its all part of the risk you take when you drive in these conditions.
On that note, I am going to sign out and be ridiculed because somone doesnt like the facts, and has to argue with eveyone about everything because they are right.

If you hit a car that is in the process of spinning out, if they cross into your lane from another, not your fault, its the driver of that vehicle, however, if it spins out, and was driving infront of you prior to spin out, and you hit that vehicle, it then becomes both of you at fault, because you didnt allow proper stopping distance for the conditions.

Weather CAN play a role in a crash, but it does not CAUSE a crash. (an accident is unavoidable like mechanical failure, or medical conditions causing an ACCIDENT) It is the DRIVER that causes a crash. No, i am not saying i am a better driver than everyone else however, I drove in that ice storm last Novemeber just fine. Yes, I did get in a CRASH, I was rearended by a driver who happened to be intoxicated.
Now, I have seen more accidents than either of you two can shake a stick at, and all of them (that were weather related) were because the DRIVER was at fault.
