<description>I agree with you, and I advocate separation of school and state.  Just a minor point: I don&amp;#039;t like the use of the word &amp;quot;class,&amp;quot;  because we don&amp;#039;t have a class structure.  That is semantic infiltration from Marx, whom I know you don&amp;#039;t revere.  We have a fluid movement of people through income levels.  Parents who value education come from all income levels.  If they earn little, they still find a way to get their children the best education, according to their standards.  They establish priorities.  Vouchers would facilitate that process.    Here&amp;#039;s a logic point:  Are the schools bad, and the unfortunate neighborhood kids have to go to them anyway, or do those kids and their parents make the schools bad?  Who challenges the dress codes and discipline?  Who challenges homework requirements?  Who breaks the windows and pulls the sinks out of the walls and scraws graffiti on the lockers?  Who intimidates the teachers and the classmates who are trying to learn?  Been there in the inner city.  No thanks.     </description>

My guess is that Sotomayor shares Obama&amp;#039;s view that the Constitution is flawed, because it &amp;quot;constrains&amp;quot; them by preventing the Supreme Court from implementing social justice.   However, I think the visionary Founders created a Constitution that is a living, breathing, document, written in such a way that it can be interpreted by succeeding generations, in accord with the evolution in human conscience. That&amp;#039;s its brilliance and beauty.   The drafters of the Constitution wrote that that there can be no cruel and unusual punishment, but they were not specific. Visionaries that they were, they knew that the sense of cruel and unusual might change over hundreds of years. Stocks and pillories were not considered cruel and unusual in centuries past, but the founders allowed for interpretation of some principles in accord with contemporary norms. </description>
