If you did in fact attend PLI, you were not paying attention.

Consult Farb's "Arrest Search and Investigation in North Carolina" for further on this matter. You can even contact him via email and he will be happy to explain this simple concept to you.

Also, if you'd like to see some case law, take a look at State v. Workman, 344 N.C. 482 (1996) 476 S.E.2d 301. The court ruled that an officer only needs a reasonable cause to believe the person indicated on the criminal process (note: not probable cause) to enter a residence with the arrest warrant or order for arrest in-hand.

That being said, there are a LOT of facts left out of this article, as is normal with the Salisbury Post. Keep that in mind when forming your conclusions, folks.

Charges are not required (but are likely to come). The fact that one ran a stop sign / failed to yield right-of-way can be listed as contributing factors on the wreck report. It is not necessary for charges to be filed in order to have one deemed "at-fault" by the insurance companies.

I can understand why people get upset about the ATV's and dirtbikes. While I enjoy riding them myself, I would never be so inconsiderate as to do it in a residential area. There are plenty of places you can go ride where the noise does not disturb anyone.

I realize some feel the government is restricting the citizen's freedom, but you also have to realize that there are other citizen's who feel their freedom to RELAX and enjoy the quiet of their backyards also has to be considered.

The solution is very simple: take your ATV/dirtbike somewhere else to ride.

Proud_GWM, the current noise ordinance is only applicable to "sound amplification equipment" per our county ordinance. The only things covered under that term are stereos, etc. I actually contacted Carl Ford a few months ago about amending the noise ordinance to cover excessive revving of engines, etc. He said he would contact the planning board so they could do a "study" on the matter. I have yet to hear back from anyone about it. Perhaps more people can contact the board...

The person can always petition the court to become emancipated from his/her parents if they are able to sufficiently support themselves.

I think within the city limits this is perfectly acceptable. Especially with the influx (or might "reflux" be a better word?) of gang activity.

I am in favor of this ordinance. I don't think it's too much to ask the business owner (or whomever may be in charge at the given time) to observe those inside the business and make them leave if they are under age.
I think it's a great idea.

To truly see why chases are needed, one only needs to look at the outrageous crime rates (and low case clearance rate) in cities where there are no-chase policies...do some research and then come back to the board at that point.
