If they have a GSM modulator plugged to the iPhone antenna (or out in the air space if in international waters), and the IMEI unlock query/activation service was implemented without having any database, neither Apple or the FCC would have any say or business with this permanent unlock. I'd be curious about the cross-upgrade unlock promise, since the iPhone forces you to re-activate with your carrier, thus not having the "whitelist service" that CutYourSIM provides.
