They aren't thinking he was trying to "beat" the train. He was intoxicated and was walking home from a wedding and police think he either fell asleep or tripped and fell on the tracks. Hoping he has a good recovery.

WSBT South Bend - Your Local News Leader : Investigators release new information about fatal Starke County police chase | WSBT - News, Weather,

This is a horribly sad story. I feel for the babies of the victims, especially Amber's who are now left with no mother and father. Unfortunately, as angry as everyone is, we may never know the whole story. Dale was wrong for fleeing, but he understadably was afraid of police. Who isn't scared of those flashing lights behind you; especially when you have had run-ins with authority before. It is safe to say that all 3 people have made some wrong decision in their lives but so has everyone else...no one is perfect and these two people did not deserve death for their mistakes. I can only hope that this accident will shine some light into Dale's life and hope he can turn onto a new path. My heart goes out to all the families involved. I hope someone out there will take good care of all the victims babies and make CERTAIN they do not make the same mistakes their parents did. RIP Amber and Nick.
