Keep the guy alive. Obviously being alive is worse than being dead to this guy. I prefer his day to day misery than an easy way out.

If they had believed your story and had evidence, they would have arrested him. They didn't because he told them your cats attacked his rabbits. Though only dogs are covered by the 'protecting livestock law', it can be argued that your cats were predators and he protected his livestock. That's why the case was forwarded to the DA. The officers didn't have enough for an arrest and they're hoping the DA can help them out. Forwarding something to the DA isn't a good thing in your case. It's a last ditch effort.

The other part I want you to think about is the call to the Humane Society. What are they empowered to do? Animal Cruelty is a crime. The police are trained to investigate and arrest for crimes. Why would they have you call the Humane Society? I don't want to be a Debbie Downer, but the lack of an arrest and the call to the Humane Society are a harbinger of things to come. You need to prepare yourself for the possibility that nothing will happen to your neighbor. My guess, judging from the little information I have, is nothing will happen to him no matter how many "likes" you get on Facebook..
