<description>I am not a lawyer but I fail to see how the referenced clause of the Constitution gives the President the power as alleged in the memo.  There is one important phrase in that clause that the memo failed to include.  The clause actually reads:  &amp;quot;The President shall be Commander in Chief of the Army and Navy of the United States ... WHEN CALLED INTO ACTUAL SERVICE OF THE UNITED STATES&amp;quot;.  Is the proposed action captured by that clause??? </description>
