Since they don't have income, technically they wouldn't have a tax liability. If they are forced to reduce their prices an additional 23%, they would lose even more money. I also would like to see more money as take home pay. As you stated, the consumer gets to decide how much tax they want to pay. I think, in aggregate, this would decrease consumer spending. I know I wouldn't want to make many big ticket purchases, and I think many people would think the same way. They are not saying that businesses do not pay taxes, because they do...when they make money. Lately, there has been a large number of businesses recording losses, therefore not incurring any income tax liability. In these situations, if the businesses were forced by the government to lower prices as a result of enacting the fair tax, that would actually hurt them. This wouldn't apply to those companies making a profit, as long as the marginal tax rate is above 23%.
