Contracts that eliminate the right to sue are unjust and, as the court said, unconscionable. The fact that this will put a bit of a leash on Amway's exploitative behavior is just a bonus. What a sleazebag company.

Oh, okay. It's okay for a landlord to NOT do what he is REQUIRED to do in the lease as long as the tenant has friends and family that will help the tenant deal with the problems created by the landlord's FAILURE to do what he is REQUIRED to do.

Seriously, though, your reasoning is flawed. The founders realized that they could not possibly anticipate every development or contingency, so they included a mechanism that allows us to 'amend' the constitution. Also, if we are truly to limit ourselves to the founders' 'intent,' one could argue that freeing the slaves in the 19th century was contrary to the founders' wishes and therefore a mistake. I'll give you the benefit of the doubt and assume you don't actually think we should still be practicing slavery.
