This clip from the dissent says it all--"Rather, it has simply declared syllogistically that because ‘marriage’ is a fundamental right protected by the Due Process Clause and ‘same-sex marriage’ is a form of marriage, Virginia’s laws declining to recognize same-sex marriage infringe the fundamental right to marry and are therefore unconstitutional… This analysis is fundamentally flawed because it fails to take into account that the ‘marriage’ that has long been recognized by the Supreme Court as a fundamental right is distinct from the newly-proposed relationship of a ‘same-sex marriage.’” This resistance to same-gender marriage is based on animosity, if not hatred, towards gay people which has been mitigated by the intense exposure many of us have given to proving to others that gay people are very much like the rest of our society. How else to explain the now wide acceptance and recognition that marriage equality is now receiving?

What wonderful news and indeed, each successive Federal judge has waxed more and more eloquent in defending our gay and lesbian citizens's right to marriage equality. It's like a snowball gathering size and mass as ruling after ruling comes down in our favor. Will SCOTUS find ALL these rulings to be spurious and without foundation in the law?

Yes, MrTipper, I agree with what you've written; in a perfect world you've hit the nail on the head. However, SCOTUS has four Catholic hard-line homo-haters with Kennedy having written in our favor regarding the Colorado Amendment 2, but he's a swing vote which means unpredictable, plus Kagan might have to recuse herself having been solicitor-general. I'm not looking at the clear logic of your opinion, I'm looking at the numbers. Progressive cases before this court have been defeated by many 5-4 votes.

If I weren't an athiest I would have heard the choir and the tambourine. Obama had everything except the call to accept Jay-sus as your saviour! The ministry is safe with Obama.
