The four year rule applies to 14 & 15 year olds. The problem really comes in when the 14 or 15 year old lies about her age, a sexual incident occurs, and the person who is older is unable to use 'defense of age' as a defense. Iowa has one of the longest prison sentences and subsequent sex offender punishments for this type of "crime" as in most states if the girl (and it usually is a girl) is 15 and the guy is 4+ years older the prison sentence given is usually 1 - 5 years, if they get any prison time at all. Any judge or CA can come up with all different kinds of sentences in varying cases. This bothers me because I know someone who is in on a 15 year sentence because he met a girl online who said she was older (she was actually 15), she went to great lengths to "prove" it, they didn't even have full sexual contact, it occurred one time, and he's sitting in prison while this guy knew full well what he was doing to a 4 year old and he gets probation. In the case of the person I know, the CA wouldn't accept anything other than charging him with sex abuse 3 and enticing a minor on consecutive sentences. It's just ridiculous. I pray for the victim in this case and hope she doesn't remember too much of what happened to her and, if so, I hope they get her some good counseling.
