Oh! The HORRORS! Smuggling banned candy! I think the American Dental Association is behind this.

Now EVERYONE is going to want to try to sneak this stuff across the border. Soon there will be nefarious people skulking about in dark alleys wearing trenchcoats with pockets full of Kinder-eggs and selling them to our youth who don't know any better.

Sorry dude. There is a presumption of innocense UNTIL PROVEN GUILTY IN A COURT OF LAW. The dude on the porch cannot be convicted of a crime that he may or may not have intended to commit UNTIL it goes to trial.

He "can" be charged with burglary or ATTEMPTED burglary IF law enforcement or the prosecutors office believe they have enough evidence to corroborate the charges. Drunk and stupid is NOT a capital offense. HAD he breeched the door and the homeowner shot him on the inside of the threshold, it's a whole different ballgame.

You would have to prove criminal intent. If the guy was so drunk he thought he was at his own home and his domestic partner had locked him out, your whole arguement goes out the window. A good defense atty can blow holes in your arguement enough to create reasonable doubt.

I completely agree with the right to defend home and hearth with deadly force... it's just going to be really hard for this homeowner to prove. Would have been better if his wife pulled the trigger while he was sick with the flu.

Your last 2 lines are the whole point. If he had time to repeatedly warn the would-be intruder; he also had time to dial 911. And wait it out. I'm curious to see how it plays out but I'm guessing the homeowner is going to be in a real mess.

This will be ruled unjustified.... and could open the homeowner up to a lawsuit. (sad to say) If he had time to warn the intruder several times, he also had time to at least DIAL 911. Firing thru the door will be his downfall. To make it a "good shoot" he should have waited til the bad guy actually broke in.

As long as the door is still standing between them, he can't pull the trigger. But you better believe the hammer would go down on MY gun as soon as that door gave way!

Shock Wave- The rapid expansion if air caused by the sudden and extreme heating of the air in a lightning channel during a return stroke. The shock wave continues outward for a few hundred yards, moving faster than the speed of sound, and then slows to a sound wave, heard as thunder. The shock wave from an extremely close lightning strike can knock a person off his/her feet, and cause hearing damage and/or other injury. These shock waves can also damage objects directly struck or nearby objects. Think about the shockwave surrounding a few sticks of dynamite detonating.

The average peak power output of a single lightning stroke is about one trillion watts — one terawatt (1012 W), and the stroke lasts for about 30 to 90 microseconds.

A shotgun discharges far less energy than the average bolt of lightning. There is recoil knocking back into you from the discharges of gasses from the end of the barrel, but far less than a lightning strike.
