LOL, you just proved my point. First off, the code isn't asking for patient information. Nor is it asking from the state heath agency to provide a listing of care-givers. It requires the same rules as the state has...register yourself in the town or else you are in violation of the regulation. Pretty simple. If a care-giver doesn't register, pretty much they can be shut down by the municipality.

You didn't include the whole section when you quoted it. You missed one spot, "Authorized employees of state or local law enforcement agencies shall be granted access to the information contained within the state health agency's confidential registry only for the purpose of verifying that an individual who has presented a registry identification card to a state or local law enforcement official is lawfully in possession of such card."

Proving proof that you're a registered caregiver is not "confidential" information. You have to provide this information or else you're breaking the law by growing and dispensing. Please...don't run around in circles claiming the sky is falling when it is not. Read the law and the municipal code and then let's discuss.

Unfortuntaly the folks above are all misinformed. The law allows for municipalities to register caregivers if they are conducting a business, which as defined by Colorado statute, caregiving is. They are not doing it for free. Similar to registering doctors who practice from their home, if the municipality cares to register these businesses. That is different from requiring the caregivers to turn over patient information, which is not required by the municipality and violates HIPAA rules.

Basically, Monkey's comments are very uneducated and really makes everyone in Berthoud smarter than him.

No, caregivers don't register and if they are found to not registering, Berthoud now has legal measures that ARE enforcable according to state statute and now municipal code. Maybe other municipalities can take this as an example instead of outright banning another business.
