Get one with a serial number where the 4th and 5th digits are less than 40.
I got one that was 41 and it had the new bootrom even though it still only had fw 3.1 :(

I just tried my week 40 one and it JB'd instantly with no issues at all.
The screen has the dreaded yellow tinge though, I can't win.

Yikes, well no, I haven't tried JBing the week 40 one yet. It definitely has [iBoot-359.3] and not [iBoot-359.3.2] like my week 41 one. Hopefully it works!

What are the 4th and 5th digits of your serial number? That is apparently the week of manufacture.
It looks like 39 and under you are ok, 40 you could get either and 41 and over you are scewed.
The best way is like said before though, DFU mode and System Profiler.

I bought 2 together and one had a serial number that said week 40 and the other week 41. The week 40 one has the old iBoot, but the week 41 the new :(

The surefire way is to put the phoine in DFU mode and look at the usb device in system profiler on Mac. Not sure of a way to do it in Windows.

I wish I had this info when I got mine 48 hours ago :( My 4th and 5th digits are 41. My friend who bought one at the same time as me got 40, so hers is fine. The guy in the shop grabbed both out of his cupboard together and unfortunately gave me the newer one, talk about bad luck :(
I finally jumped on the iPhone train after resisting for ages and I got pwned.

I'd love a JB right now, my phone is unlocked by the carrier, but I have the dreaded [iBoot-359.3.2] :(

Ok, so now I'm getting over the disappointment of my first plunge into the world of iPhones resulting in me getting one with the dreaded [iBoot-359.3.2.] I'm wondering if there is any known method of JBing these with a tethered boot? It could be slightly annoying, but a whole lot better than no JB at all.

Well, now I know I wasn't doing anything wrong.
I am so pissed right now, bought my iPhone yesterday, I can't believe they had these new ones in shops in Australia aleady :(
