<description>I suppose it would depend on the circumstances, wouldn&amp;#039;t it?  Were there witnesses?  Surveillance cameras?  Was he injured and/or stuck in the vehicle when police arrived?  All of those things would (possibly) prevent him from arguing that he wasn&amp;#039;t driving.  Guess we&amp;#039;ll all just have to wait and see.   </description>

<description>I don&amp;#039;t think he&amp;#039;d be able to argue that he didn&amp;#039;t drive through the doors, but he certainly could try to dispute why he drove through the doors.  The question would be: did he do it on purpose, have a true accident (like a mechanical failure on his car), or have an accident due to some sort of impairment?  I think that&amp;#039;s the part folks should reserve judgment on.    </description>

<description>Bing, it&amp;#039;s actually the state that requires a victim for each crime, not the cops.  If there&amp;#039;s a crime, there has to be a suspect and a victim.  It&amp;#039;s a little messed up sometimes since there may not be a true victim for each crime but crime reporting statistics require these labels. </description>

<description>It sounds like the Cadillac driver did the escalation.  All the deputy did, per the story, is flip on their emergency lights to initiate a traffic stop.  Most people&amp;#039;s reaction would not be to swerve into oncoming traffic, so there was no expectation on the deputy&amp;#039;s part that there was a danger of anyone getting hurt.   </description>

<description>I&amp;#039;m not kidding, nor am I naive.  I just have a law enforcement background.  Police don&amp;#039;t charge someone with a crime if they can&amp;#039;t back it up, generally.  I won&amp;#039;t say that officers are perfect all the time, because they ARE human, but the goal is to find someone who has done something unlawful and arrest them for that crime.  The law can be tricky and it isn&amp;#039;t always clear why certain charges are warranted without obtaining a copy of the report.    But I do agree that the arrestee in this case does need help and I genuinely hope that, should they reconcile, this doesn&amp;#039;t happen again.  I was a DV victim and I was very glad that multiple charges were put on the suspect in that case as his actions affected me far worse than just physically.  I don&amp;#039;t know what his bond was in that case, but I guarantee that it wouldn&amp;#039;t have felt like too much to me, no matter how high it was.   </description>

<description>The police charge as they see fit based on evidence.  The DA&amp;#039;s office is responsible for the charges after arrest, including whether the suspect takes a plea or not.  The police have zero control over the charges after the suspect is arrested and jailed, so I doubt that charges are &amp;quot;piled on&amp;quot; in hopes of a plea.   </description>

<description>I would argue that many Hispanics are not white because their origins are likely also Native American and/or African.  I don&amp;#039;t identify as white because I am Hispanic with many Native American ancestors.  Afro-Cubans are also Hispanic, but not white.  Hispanic folk are all different races, depending on their background and ancestry.   </description>

<description>I have to disagree.  I won&amp;#039;t call this racist because it&amp;#039;s based on your observations rather than assumptions, but I tend to think that generalizations such as yours are not accurate.  While I am not great at math or physics, my sister is easily the most intelligent person I know: she graduated from CU with honors with a double degree, one being Aerospace Engineering.  We are Hispanic.  She and I just had a great academic foundation and we had parents that encouraged us to always do the best we could academically. The issue lies with the parents&amp;#039; involvement, in my opinion.  Race factors in far less than cultural and generational ideas. </description>

<description>They probably don&amp;#039;t have the name yet.  They can&amp;#039;t print something they don&amp;#039;t have.  As for why they wouldn&amp;#039;t have it...who knows?  Perhaps there&amp;#039;s some aspect of the investigation that officials feel may be harmed by the release of the name.  I&amp;#039;m sure we&amp;#039;ll all find out in due time.  The greater concern, in my opinion, is making sure that everyone affected by this disaster has the help and support they need.  Having the subject&amp;#039;s name wouldn&amp;#039;t do anything in that aspect. </description>

<description>You seem to forget that police do not actually make the laws.  They enforce them.  This law is on the books.  While I grant that is open to interpretation to a degree, it can in fact be enforced as it was in this case.  This person was given 2 opportunities to leave before being arrested after the 3rd violation.  I feel that this was completely reasonable.    I certainly don&amp;#039;t expect to change your mind about the validity of this arrest, given your general disdain for all things law enforcement.  Maybe if you were to obtain a copy of the arrest report (which is public record), the probable cause for this arrest would be much more clear.   </description>

(1)  It is unlawful for any person to enter or remain in any public building or on any public property or to conduct himself or herself in or on the same in violation of any order, rule, or regulation concerning any matter prescribed in this subsection (1), limiting or prohibiting the use or activities or conduct in such public building or on such public property, issued by any officer or agency having the power of control, management, or supervision of the building or property. In addition to any authority granted by any other law, each such officer or agency may adopt such orders, rules, or regulations as are reasonably necessary for the administration, protection, and maintenance of such public buildings and property, specifically, orders, rules, and regulations  It&amp;#039;s not made up at all.  And he disregarded instructions to stay away 3 times, so trespass was a valid charge.  </description>
