<description>Most tort reformers have either capped damages, or enhanced the pleading requirements for filing. I doubt either of those two measures would in any way limit McGinnis or Random House&amp;#039;s liability.    The infractions are just too flagrant. And the internal e-mails from Random House&amp;#039;s in-house counsel amount to the &lt;i&gt; only &lt;/i&gt; smoking gun proving &amp;quot;actual malice,&amp;quot; the constitutional standard for defamation liability when the target of the libel or slander is a public figure, that I have ever heard of. In short, this is one of those few times that someone (McGinnis) has done something so stupid, so reckless, so beyond-the-pale that he will lose in court even when the protections of the 1st Amendment attach.    To summarize, the only &amp;quot;reform&amp;quot; that would prevent this lawsuit would be to close the courthouse doors to the Palins outright. And if that&amp;#039;s the reform you have in mind, that makes &lt;i&gt; you &lt;/i&gt; just as facist as I imagine you would label conservatives: all too eager to goose-step over the Palins due-process-rights in your jackboots and brown shirt. </description>

<description>I have actually heard that his internals suggest that while most of the black community &lt;i&gt; that turns out &lt;/i&gt; will vote for him, they are unlikely to show up to the polls in droves, like &amp;#039;08.  That means that there mightn&amp;#039;t be enough DNC-tilted voters to carry the electoral math of numerous states.    You can hear the intense frustration of the crowd with the President if you go take a listen to recordings of the event.  I would say the black community is pretty angry.    To that point, from what I hear, &lt;i&gt; Michigan &lt;/i&gt; is unlikely to go for him if the election were held today.  If true, that is momentously significant--that would mean he is in serious trouble in the rust belt.  It would also help explain why the DNC is fighting so hard to get North Carolina, i.e. bringing the convention there.  Anyway, all of that to say:  I think we may actually be seeing the first fault lines between this Marxist President and the Black Community. </description>
