Your comment made it sound like the person shouting should have been arrested for not breaking any laws. Shouting at your husband (while frowned upon in public and by husbands everywhere) is not going to land you in custody unless there is a threat. =)

Yes, that is how I would interpret the law. Having witnesses approach the authorities to report that this guy was making threats to a family member shouldn't be enough to have him arrested. I suppose it all depends on the type of threat he made as it could have impacted other bystanders by putting them in fear too.

It doesn't matter if the authorities believed he would act on those threats. If the person that was threatened was in reasonable fear that the threat would be carried out, the guy would be arrested. Here is a snippet of RCW 9A.46.020 that applies here: The person by words or conduct places the person threatened in reasonable fear that the threat will be carried out. "Words or conduct" includes, in addition to any other form of communication or conduct, the sending of an electronic communication.

Correct - if he shouted threats, and someone was in fear that those threats would be carried out, he would be violating RCW 9A.46.020 and would be subject to arrest.

Per RCW 9A.46.020: (1) A person is guilty of harassment if: (a) Without lawful authority, the person knowingly threatens: (i) To cause bodily injury immediately or in the future to the person threatened or to any other person; or (ii) To cause physical damage to the property of a person other than the actor; or (iii) To subject the person threatened or any other person to physical confinement or restraint; or (iv) Maliciously to do any other act which is intended to substantially harm the person threatened or another with respect to his or her physical or mental health or safety; and (b) The person by words or conduct places the person threatened in reasonable fear that the threat will be carried out. Either way, people are still going to be consuming the same amount of soda. Limiting the size of the container will just make it more of a hassle I guess. If I choose to drink 800 gallons of soda in one sitting, I should be able to do that. I drink soda all the time...and I do mean all the time!. However, I also exercise regularly and that 40 oz Big Gulp doesn't really impact me or make me fat.
