Yes, it's a fact that he's on probation for DWAI, but it has no relevance to the accident. If he had been drinking prior to the accident THEN it's a story. I think it was a tasteless move by the DC given what this man has just gone through.

What difference does it make what side of the white line the cyclist is on?? According to the Colorado State law cyclists have the same rights to be on the road as any other motorized vehicle. Definitely. I didn't mean to imply that it was the drivers fault in any way. We ALL need to be careful, peds and autos alike (and bicycles). This just seems like an accident that could have been avoided. I couldn't imagine how the driver must feel whether it was his/her fault or not.

Dang! I hate reading stories like this. Here's to hoping that this man survives and makes a full recovery. Please drive carefully out there. The roads are still slick in spots and probably will remain that way for a few days given the cold temps.
