In other words, Manafort was playing a double game. On the one hand, he was pushing the anti-Semitic meme against Obama in the press. On other hand, he was saying: "Look, I (actually Yanukovych) stopped the Israeli's from making things worse."

Kavanaugh's lies are of the Rehnquist variety rather than the "lie" of "balls and strikes." (I remember having some insomnia while the hearing for Rehnquist's nomination to be CJ was being held. Watching it on C-Span at 3 or 4 in the morning I actually shouted out: "He's a f**king liar!")

Not true. All prosecutions of this sort work from the bottom up. In due course, I expect that there will be indictments of Manafort and Trump, Jr., at the least.

Look: Alpha files a lawsuit against Beta. Alpha prevails with respect to his lawsuit against Beta. Beta then sues Alpha claiming that he has been damaged. In Beta's lawsuit, the alleged damages are the amounts he is required to pay to Alpha via the judgment brought by Alpha in the initial lawsuit. In other words, Beta's damages are the amounts the court in Alpha's lawsuit required Beta to pay to Alpha.

That's preposterous.

Saying "I want to diddle little boys" is a statement indicating criminal activity, thus leaving one subject to blackmail and extortion. Saying "Trump is a narcissistic sociopath" is a correct statement of actual fact that would lead an observer to conclude that the declarant had astute powers of observation.

I would agree with that, but Moss' "third option," the one that Trump chose, bypasses any judicial oversight. Thus, while there may be a First Amendment issue, it is beyond review.

The media typically examines the question of whether Trump, himself, colluded with the Russians by focusing on various points in time during the 2016 campaign. However, this overlooks the concept of "accessory after the fact." See 18 U.S.C. § 3 ("Whoever, knowing that an offense against the United States has been committed, receives, relieves, comforts or assists the offender in order to hinder or prevent his apprehension, trial or punishment, is an accessory after the fact.")

It can be reasonably argued that Trump, in 2017, committed this offense. Thus, he has already committed this crime. However, imagine the following: An indictment against Trump, Jr., Manafort, and Jared centering around the Trump Tower meeting. In reaction, Trump dismisses Rosenstein and dissolves the office of the special prosecutor. At that point, we're squarely within accessory after the fact territory.
