Well, if by "Oscar", you mean "Award given to the film that a bunch of old white men felt reaffirmed their entire existence", then, they're right. "Selma" would not qualify for that award.

I think perhaps the problem is in first assuming that an AMPAS award is remotely related solely to excellence in film craft. It's really only for high grade film craft that supports a certain worldview.
