Given that Cruz was born in Canada, he has a Canadadian birth certificate. He doesn't have an American birth certificate. So what do people who are born abroad to American citizens show when they need to prove to a government agency that they are American citizens? I would guess that is what the Consular Report of Birth Abroad (CRBA) is used for. Does Ted Cruz have one? Apparently not. So how does he get a driver's license, a social security number, and all of the other things you need to show proof of citizenship for?

These make it pretty clear don't they? Thanks for posting this.

"A person born out of the jurisdiction of the United States can only become a citizen by being naturalized...by authority of Congress...as in the enactments conferring citizenship upon foreign-born children of citizens"

That exactly describes Ted Cruz's status. He is a naturalized citizen according to the Supreme Court of the United States. He is a foreign-born child of an American citizen.

Gen_Z is correct as long as you define "constitutional expert" as excluding anyone who believes that a natural born citizen must be born on US soil to US citizen parents.

Bill is right. They don't just put extra superfluous words like "natural" in the Constitution. They would have used the term "born citizen" if that's what they meant, but instead they used "natural born citizen".

The naysayers keep telling us that the citizenship laws of other countries, like Jordan, don't affect the citizenship laws of the US. So it doesn't matter what Jordan's citizenship laws are does it? The US still recognizes the children born to the American citizen mother in Jordan are natural born citizens according to Masin, no matter what Jordan's laws are.

Here are some quotes from the ruling. It's interesting to keep in mind when reading the ruling that, before the law changed in 1934, Ted Cruz wouldn't even have been recognized as a citizen of the United States let alone a natural born citizen.
-------------------------------------------------------

“This case involves a purely legal issue”

“I CONCLUDE that the objectors have standing to challenge Senator Cruz’s eligibility”

“The issue is therefore justiciable”

“the meaning of the Constitutional term “natural born” is a very legitimate subject of legal and historical debate”

“it is by no means a frivolous matter.”

“The United States Supreme Court has never addressed the “natural born Citizen” question in the context of eligibility for the Presidency”

“The Constitution neither defines nor elaborates upon the phrase, “natural born Citizen.””

“The meaning of “natural born Citizen” must then be determined with reference to its meaning under the English, or as it is also referred to British, common law”

“As the Supreme Court has noted, words and phrases used, but not defined, within the Constitution, should“ be read in light of British common law,” since the U.S. Constitution is “ framed in the language of the English common law.” Carmel v. Texas”

“under jus sanguinis, he arguably could be considered an American citizen at birth, and arguably be a “natural born Citizen.””

“Jay did not elaborate upon his understanding of “natural born Citizen.” Presumably, he assumed that Washington knew its meaning. Or at least, the meaning of the term “natural born subject,” for that would have been the context in which the “natural born” label would have applied in English law, where one was a “subject” of the King or Queen, or if not, was an “alien.””

“However, as the Constitution adopted English “common law,” it is necessary to ascertain exactly what was the “common law” that was adopted”

“the issue can never be entirely free of doubt, at least barring a definitive ruling of the United States Supreme Court”

“I CONCLUDE that the more persuasive legal analysis is that such a child, born of a citizen–father, citizen-mother, or both, is indeed a “natural born Citizen” within the contemplation of the Constitution”

------------------------------------------------------------

So, Winston Churchill was a natural born Citizen of the United States. Who knew?

The ruling in New Jersey, Victor Williams v Ted Cruz http://media.philly.com/documents/Judge's+ru...

Philly.Com Article http://www.philly.com/philly/news/20160413_Judge_...

Judge Jeff S. Masin essentially said this is a legal issue, not a political issue. It is not frivolous and ultimately the US Supreme Court needs to decide this.

Justice Clarence Thomas said "We're evading that one" in reference to the Supreme Court answering the question of whether a person not born in the US is eligible to be President. The Supreme Court is where all of these eligibility cases go to die. We don't have justice in America anymore. The courts have abdicated their responsibilities and no longer care about upholding the Constitution. We are now a nation of men and not a nation of laws.
