http://vimeo.com/4895023 Women who have felt the overwhelming controlling measures surrounding birth, will also feel this woman's pain and anger for the type of control exerted by the "state". Can any woman imagine having the JUDGE standing in your room while you are in active labor? Begin questioned WITHOUT legal representation and being told just exactly you WILL do according to someone else's dictate, surrounding your body? http://en.wikipedia.org/wiki/Pemberton_v._Tallaha... I had a VBAC after beging told by my Dr that it was too risky, but when I went into labor before my scheduled c-section, that DR was on vacation, a different attending Dr gave me the option to a trial labor/VBAC and that she would be ready should the minimal risk of rupture happen. I did NOT have to have my daughter cut from me. People submit knowingly to medical procedures all the time that carry higher risks to their person, then the 2 to 6% risk of uterine rupture from a previous vertical c-section. Honestly, in the case of rupture, it is the MOTHER and not the baby that is in grave danger. The excuse they are trying to protect the fetus is BS.

I think they should light a match to both versions and have a weinie roast. Absolutely the worst waste of a tree to date...not to mention all the money and resources used to try and push this farce down America's throat.

This woman could have been like my friend and wake up one day and not feel the baby move at it's usual active time. She drove to the OB office and found out her baby had died at 32 weeks gestation. She was later induced to birth the stillborn. Nothing would have changed the outcome, UNLESS, my friend would have been in the hospital, prepped for surgery and hooked up to a fetal monitor 24/7, and even then, it's not completely evident that they could have successfully saved the infant. I know it is hard to accept, but great outcomes aren't an absolute guarantee in pregnancy. Sadly, this woman WAS in the facility under court order, under the care of a medical professional that used the law to hold her there, (can we assume hooked up to a monitor???) and the baby died in utero anyway. A spontaneous abortion can happen at anytime, anywhere, for any of a multitude of reasons.

What would be the reasoning behind the c-section? I would like to know what monitoring was done, medications and other pertinent information regarding the demise of the pregnancy and the determination of the pathology tests done on the placental tissue and baby. A baby at 24 weeks gestation "could" survive outside the womb, but what level of care would be needed immediately and what are the possible life-long complications associated with a pre-term baby at that gestation date? It is arguable that this baby could not have survived without significant medical intervention within moments of it's birth. The insistance of the Dr. alluded to the baby's need to be in the facility and used that to force the woman to remain hospitalized.

You've revealed enough for me to believe that fundamentally, we are on the same page. Our differences of opinion in some points could be blamed on gender view point. I do have the ability to critically look at my fellow gender members and recognize it's faults for what they are. I can't excuse poor personal choices because of gender. I can also empathize with the plight of the opposite gender in situations where "justice" is metered at a different rate. Even though your first posts caused my alarms to go off, I can appreciate that you took the time to clarify where you are coming from. I am fiercly protective of my being, and my ability to make my own choices. I believe that to maintain that freedom, which I value, is to accept that if I shall fail to make a good life choice, it is MY choice that led me to that crossroad and MY issue to resolve or live with. I believe that my freedoms should not be restricted, but also realize that not all people are created equal in moral compass. Thus the need for laws governing the actions of individuals that inflict significantdamage on others, will always be necessary.

"We cant force a woman to term but if she goes to term a man should have the option to opt out of anything to do with the child. Essentially a male version of not taking responsibility like in abortion. " AH, I get it. Well until that final physical hurdle is overcome, the reality is that men aren't wholely equal to women. With that said, I can somewhat understand the emotions behind your desire for equality under the law. I often wonder if the guys that feel this way, either have been stuck with support payments that they didn't want, or are terrified that they might fall victim to a woman who chooses to carry the result of their union. I think about the kids. It sucks to grow up knowing that one of your parents HATES that you exist, that you are a burden to their life that they wish not to have. I hate women who trap men, and I hate guys who think they can just walk away. The party that hurts the worst is the child and what did they do to deserve that?

I just got done reading 6 pages of posts on the NYT's Motherlode. The majority of "voices" chiming in on this case, come from women, and they support the opinion that this woman's rights were violated. There is a resounding "Oh hell NO!" feeling. Whether a woman is pro choice or pro life, matters not. I am Pro-life for MY own personal choices, I cannot condone the elective demise of my own pregnancies. I respect that other women have the right to be Pro Choice, it is their body and their decision, period. I throw all my support behind pregnancy PREVENTION. If it never happens, a decision to abort never has to be made. This is not just a left or right wing issue. It's not fair to assume that PRO LIFE means that the fetus is more important than the mother. A few might feel that way, but they don't represent the mainstream beliefs. I've encountered far more control attempts, coming from my ultra liberal MIL. This is a civil liberties issue. The ramifications of this ruling could eventually impact far more than just pregnancy if this is allowed to stand.

LMAO! You sound like my MIL. HAHAHAHA, do you always believe everything you are told by your betters? If smoking caused miscarriages SPECIFICALLY, don't you think there would be a higher number of them? How do you answer the fact that they happen to non-smoking women too? I am glad my OB and nurses weren't Nazi's, forcing their will upon free persons. They respected my right to go outside and have a smoke, and didn't call some judge to force me to do their bidding. Here is a question for you...When faced with a dire situation, who does a dr save first, the mother or the baby? Which would you choose?

Perhaps people should do a little searching on the web for more information on this case that is NOT from the extremely leaning AP. When you are done reading and thinking about your STUPID blame the mother instincts, you may realize that there is more to this story than a cigarette. AP did a bang up job of creating a certain "air" of opinion. It's odd that several other lefty leaning blogs seem to have a different view of this situation and have rightly focused on the Constitutional RIGHTS of this woman. How on earth can ANYONE pull strings and have a court order placed, OVER THE PHONE, on someone who was not allowed to even offer up their own statement. By the time the baby was taken, 3 days later, after her court forced hospital stay, it was DEAD already. AT WHAT point...did the baby DIE? I can't wait for discovery... The demise of a troubled pregnancy cannot be stopped once it starts, no amount of bedrest will change that FACT! I am amazed at the number of idiots willing to usurp a woman's right to her body and choices, but probably still support the freedom to choose an ABORTION.

Breitbart.com : Schwarzenegger says he\'s heard voters\' anger

Liberals just LOVE democracy...when it works for their agenda. I wonder how many self proclaimed liberals got out to vote? As the numbers stand right now, all measures were voted by at least a 2 to 1 ratio. Now that's a majority! As blue as the state is, that could only mean that some of them did indeed jump ship and vote conservatively. Now will they publicly announce they didn't support the measures their nanny state wanted to impose? OR, go back to complaining about the needs of this or that group?

Breitbart.com : Among 4-year-olds, 1 in 5 obese, study finds

Poverty isn't the problem, it's the excuse. By providing even more governing to the NANNY STATE of this country via the FDA and the USDA, our foods are no longer basic fuel for the body, but complex, genetically engineered, mass manufactured, additive infused, lab created, taste enhanced, fumigated, and preserved GARBAGE. ANY non-refridgerated food, with the exception of many fruits and veggies, that have a shelf life of more than THREE days, and isn't closest to it's most natural state is not healthy for us to eat. It's pumped full of chemicals to make it for weeks to months or even years on the grocery shelves. IF one reads the ingredient list and can't pronounce or spell something on it, it should go back on the shelf. Avoid the junk food and pre-prepared crap, stick with fresh, whole foods closest to their natural state and the cost at the bottom of the receipt isn't that much different. What was normally wasted on purchasing processed convenient foods and junk can be spent on better choices. Your body will thank you for it!

I find a major fault with this study. At such an age, it's possible for many children to be pudgy...many carry their baby fat well into elementary school and lose it as puberty hits. Also, measurements of obesity don't take into account bone structures or muscletone. Kids that are built larger and weigh more aren't necessarily an obesity statistic. A true test of obesity and fitness takes more into account than just height and weight calculations. Having said that, there are children at high risk at younger ages. They are more than a little pudgy and their eating habits are horrible. As a parent, I have taken the time to monitor my kids intake and provide balanced meals as much as possible. With my continued practice of providing good choices, they have learned to make good choices over bad. They have learned what portion sizes are and they have learned about nutrition labels. Thru example, it is possible to create and foster good food habits.

I watched the debate on this bill, on c-span today. For once I was yelling at the TV less than they were yelling at eachother in the House. It was a snake pit and the venom flowed freely. B. Frank was a bumbling idiot, too busy posturing his indignation and spewing BUSH BUSH BUSH to realize he really needed to shut his piehole.
