We didn't have a choice of "regulate or not regulate" , we had a choice of "not regulate or not collect any tax revenue" from these people and their trading operations. One thing for sure is Madoff was running an offshore unregulated hedgefund and not under SEC jurisdiction-as testified by SEC commissioner Chris Cox, as Cox admitted before Congress, the SEC had NO AUTHORITY over Bernie Madoff unlike other SEC regulated companies.
