You're right those kind of actions will expressly make someone not protected by the Geneva convention, but realistically we're still going to grant at least the spirit of the Geneva convention to all captured combatants even though we don't have to. The point is that it's not illegal for an Afghan or Iraqi to fight American soldiers while defending his homeland, however when such people are captured we can still hold them until the war is over if for no other reason than we want to deny their future use to the enemy. Therefore this entire notion that these people deserve trials now before the wars are over is completely absurd. Once the wars are over we can go about determining if these people committed any crimes.
