Not sure about that. The Scottish election will, once again, be about independence. The conservatives remain the only party who are unequivocally unionist. That is what has brought some success recently and will continue to be the best way for them to win votes.

Maybe Mr Miller will appeal against the rejection of his claim challenging the policy itself. I doubt it but it's not impossible.

The common law is judge made. If parliament wants to overturn a particular decision it can do so my legislating. The difficulty arises because of the HRA which allows judges to decide on proportionality and social and political issues. A power given to them by parliament ironically.

He is too young and not smart enough for an important constitutional role like that. And he wouldn't be allowed to speak out on political issues, likewise his wife. A total non starter.

That case had nothing to do with the HRA and indeed it has not even decides yet whether the claimant was unfairly dismissed (or indeed the reason for his dismissal). A preliminary issue was decided, namely whether "ethical veganism" is a protected belief. Again, that is a question that parliament has legislated for the tribunal to determine in the Equality Act.

There is no difference between the two. The problem is the HRA and EA which allows the courts to decide controversial questions of policy. But that is the law as made by parliament. Blame parliament not the courts.

That is how the common law works. The law usvdeveloped (or discovered) by the courts, with the higher courts decisions binding the lower courts. If a particular decision is thought to be wrong or undesirable, parliament can legoslate.
