Daily Camera.com: : Judge: Boulder late in releasing utility data, but city can withhold software - Boulder Daily Camera

Mr. Murphy, you were so very fortunate to have legal help on a pro bono basis. Most CORA cases cost $25-50K if you can keep them simple. They are beyond the reach of almost all citizens. The law needs to change so that more citizens are able to obtain the information that they want from the government. I hope that you will appeal the court's ruling on the formulas and data. What you are seeking is obviously not software. Good luck.

Your demands for "transparency" are misplaced. Citizens have rights to privacy. Governments must be transparent. Any citizen willing to fight the good fight in the courtroom is plenty transparent. He puts his name on his posts here as well. It is of little importance if someone had helped with legal fees to achieve greater government transparency. Little real transparency would be forced from government if there were not private self-serving interest who invest in trying to bring sunshine into government operations.

Sounds to me as if there is much more they should have turned over. They have withheld data and formulas---(both are public records)-- NOT "software" which of course they are allowed to withhold. I hope that you are going to appeal the decision.

Loveland Reporter-Herald : Concerns rise as Loveland special election looms - Loveland Reporter-Herald

The clerk's statements present a high-risk position here. A close and analytical study of the statute will reveal the legislative intent not to allow someone else to deliver your ballot. Nowhere does it allow someone else to deliver your ballot. However, in the state, federal, county, school board, and city ABSENTEE ballots, there are clear provisions (with risk mitigation) to allow 3rd party delivery. But NOT for this type of election.

Loveland Reporter-Herald : City clerk reports fraudulent \'ballot collectors\' in Loveland fracking election - Loveland Reporte

Voters and law enforcement officials, ---the clerk and the ballot harvesters have it wrong. It is illegal for anyone but the voter and the USPS to deliver the voter's ballot in this type of LOCAL election. In February the law changed to degrade the entire local election code for mandatory mail ballots. They took away all the security risk mitigation for mail ballots in local elections. Therefore without security mitigation, the law does not allow anyone but the voter to deliver the ballot. This is in HB14-1164. I am guessing that whichever side wins, the result will be challenged in court because too many illegal votes have been cast. In the state primary election, voters CAN have someone else deliver their ballot, although it is a risky idea.

Home - Broomfield Enterprise : Hearing set for Wednesday for Broomfield fracking vote certification issues - Broomfield Enterprise

I don't think that Broomfield voters generally recognize that some City officials purposely rejected some legal ballots of Broomfield voters who had merely moved within Broomfield during the weeks before the election. We asked them not to do this irreparable harm, but they flatly refused. Now those votes cannot be retrieved and can never be counted. Other voters who were not qualified to vote because they were new to Broomfield had their ballots counted for Broomfield races. No one will ever be able to short out who won or lost.

If only you were right. That is the way it should be. However, the clerk will not allow the Canvass Board to see any of those provisional ballot applications or data. It is all hidden behind closed doors and the work is done by hand-picked people without bi-partisan or multi-partisan oversight. Ballots counted in the dark. That is what part of the debate is about. There was no independent check on these rejections or acceptances and the canvass board feels they should not sign off without checking into some of the "insider" reports they got on how lousy the sysem was.

Nope. They merely wanted the clerk to follow the law, and allow watchers of all parties to exercise their rights to verify the signature verification work and correct any errors while the process was going on. I live in Pitkin County and any party or issue committee can send in an authorized watcher to verify the work of the signature judges and challenge, question or correct when there are problems. Many times a watcher can help get a ballot approved that was initially rejected in error.

I suggest that you read the state law that REQURES the canvass board to correct "imperfect" returns, to determine whether there were errors or ommissions, to investigate voter complaints about voting systems, and there are a host of other duties. Also there is a new SOS rule that REQUIRES the canvass board to report by ballot style. That ballot style information was withheld from the canvass board. While the SOS Rule is likely flawed, the Canvass Board is required to try to follow it , or get the SOS to correct the rule. Hall and the County attorney claim that canvass board members may be sued personally if there are problems and the county will not defend them. So if you were a canvass board member and knew that you could not honestly sign that you had met the requirement of the rule and law, would you sign? And risk that a disgruntled candidate or issue committee would sue you?

Should they have been rejected? would be nice to have an independent test. If you deal with the facts instead of partisan unfounded accusations, perhaps there might be some progress on dealing with the issues.

Ms. Layton's letter is right on point. As a Democratic primary candidate for the House of Representatives and a long time election quality activist, she knows the guts of elections like few people do. She knows that the public would be dismayed if they saw how their votes are handled and many times mishandled. So do the apologists for the current non-transparent system---as they demand that "voter confidence" take priority over "voter education" on the vulnerabilities of our system. It is time to quit pretending that we have an acceptable system of elections in Colorado. It is truly one of the "darkest" states in the country. This is not a partisan issue. Those who would attempt to make it a bitter partisan matter are merely attempting to deflect from the real issues that would concern voters of all political persuasions. Beware the likely nasty partisan comments likely to be posted here. Who are those likely posting under anonymous names who fear full transparency of our election process?

Daily Camera.com: : Canvass board majority to refuse certifying Boulder County election results - Boulder Daily Camera

For those who have not seen the data, they should withhold their criticism until they have.It is quite troubling. Go to the Canvass board meeting at 10 a.m. today, where Deputry Secretary of State Staiert will hear from the Canvass Board about the issues preventing their certification. She will also hear from the minority on the board who have done almost no work and are happy to rubber stamp the results no matter how many problems are exposed. Trappist99, you only give two alternatives---Martin is wrong, or there is fraud. Martin is not wrong, but fraud may not be the right description either. The irregularities are more likely caused by carelessness and human error--and not intentional fraud. The errors are compounded by the Clerk's lack of willingness to have transparent and verifiable processes.
