Back then, classrooms were routinely filled with 30-40 students every day and teachers managed them. The rotten eggs were rare and children were taught to respect the adults in charge. The judge basically agreed that the law in and of itself wasn't breaking any federal laws. The judge appears to have simply informed local authorities that they have no jurisdiction to enforce the emigration statutes of the federal government. THAT BEING THE CASE... Then apparently Arizona cannot ask anyone legal or illegal for their papers anymore. Why would a legal resident comply if it means you cannot be detained or bound over to anyone by simply declining to produce legal identification? More than that however, what of drug dealers, murderers, kidnappers, grand theft such as bank robbery. All are federal crimes routinely enforced at the state and local level. Is there now two sets of standards for different federal laws - the ones the federal government wants enforced and the ones it doesn't. I wasn't aware of the provision that said CONGRESS can make a law but the OBAMA ADMINISTRATION can ignore it while ordering states to selectively enforce the statutes it likes. To any extent she believes the state law adds a state level felony or misdemeanor above Federal law, she may have a point. However there are dozens of other similar case laws in every state that allow local authorities to enforce federal laws and state laws that "pile on" by duplicating the federal statute, so even that part of her ruling is seriously questionable. Therefore, if allowed to stand through appeals, the consequences of it not being overturned could have a far reaching affect on the enforcement of ANY federal law paralleled by any state, not just this law and not just issues confined to naturalization and emigration. Oh how I wish I were hearing the appeal because I would using existing case law over jurisdictional issues of a similar nature - tear apart her ruling (which I have now read) in so many ways! The 9th Circuit probably will not overturn her for political purposes, but the Supreme Court where the law is still somewhat meaningful MOST CERTAINLY WILL!
