And for pitchers, no injury is more serious than a shoulder injury.   You&amp;#039;re right, it could be that the Yankees have a secret innings limit for Pineda. I&amp;#039;m just reacting to what they&amp;#039;ve said. </description>

PED prosecution is moving away from cases based on failed drug tests, to &amp;quot;non-analytical positive&amp;quot; cases based on something resembling police work. Yes, it&amp;#039;s going to look nastier when the evidence is based on testimony of shady paid-off drug peddlers, as opposed to nice, clinical lab reports.   If you look, you&amp;#039;ll see that the U.S. is bound by treaty to pursue criminal prosecution of those involved in PED distribution and use. The World Anti-Doping organization has effectively admitted that drug testing is now a secondary tool, and that primary emphasis must be placed on national and international police work.  So ... MY concern is not with cases built on the testimony of paid informants, or procedural due process questions arising from the arbitration process, but the combination of these two factors. I don&amp;#039;t think arbitration is the right venue to protect defendants against the possibility of prosecutorial excess and abuse.  </description>

<description>Will, the U.S. Federal Arbitration Act (FAA) provides that a federal district court may vacate an arbitration award, among other reasons, &amp;ldquo;where there was evident partiality or corruption in the arbitrators.&amp;rdquo; 9 U.S.C. &amp;sect;10(a). This being said, it&amp;#039;s close to impossible to overturn an arbitration decision in court. But Manfred has at least given A-Rod&amp;#039;s people decent grounds to at least bring a lawsuit challenging the arbitration decision. What a mess. </description>

<description>I am trying to wrap my brain around how a party to an arbitration could sue another party to the arbitration, before the arbitration is over, concerning the investigation that led to the arbitration. Let&amp;#039;s state the obvious: from the standpoint of the arbitration itself, this is the worst tactic ever employed. It is saying in effect that A-Rod does not trust the arbitration or the arbitration process. You might as well stand in front of a judge before sentencing, and tell the courtroom that the judge is crooked. Hint: if you want a judge to impose a suspended sentence, you&amp;#039;re better off complimenting the judge&amp;#039;s choice of tailor.   Here&amp;#039;s the next most obvious thing, at least for someone who follows the law in this area: the arbitration process is damn near bullet-proof. That&amp;#039;s why it&amp;#039;s there, so that disputes can be decided privately, outside of court. The law is written to make it close to impossible to challenge in court anything associated with an arbitration. I cannot think of a single sports arbitration case where the athlete was able to make a successful end run around the arbitration process.   So, I ask the question: why would A-Rod pursue a strategy that&amp;#039;s guaranteed only to get his head handed to him in arbitration, that&amp;#039;s going to cause MLB AND the arbitrator both to wonder if there&amp;#039;s any way to increase that 211 game suspension (or at least to make MLB wish it initially imposed a harsher penalty)? The only answer I can come up with is that A-Rod is one of those clients, the ones who tell their lawyers things like &amp;quot;they must pay for what they&amp;#039;ve done&amp;quot; and &amp;quot;I don&amp;#039;t care what it costs&amp;quot;. I AM assuming that it&amp;#039;s A-Rod who is the force behind this lawsuit, because if his lawyers duped him into this crazy (but fee-generating) strategy, A-Rod&amp;#039;s best chance in the courts might be to sue his own lawyers for malpractice. </description>
