As you already stated that the blog owner is not ready to give your content back, you should write a DMCA letter to the web host of that website. As per law, web host are supposed to take strict actions against website which are copying content of others.
The other thing you can do is to contact and send DMCA letters to their advertisers.

I dont know much about Studio theme but I suggest you to try ThemeForest or Elagant Themes. These 2 are best according to me.

You have to make a copy of your template by creating a backup of it. After this, you will upload it on Intense Debate and then they will give you a piece of code (as shown in step 6) which you have to copy and replace it with your current template code and then save the changes.
