<description>I am outraged as a citizen of Yakima. The man HITS ANOTHER CAR WHILE DRUNK and then doesn&amp;#039;t have any jail time AND gets a reduced sentence?? Only one year of probation opposed to three to five if he got a DUI? And he&amp;#039;s the only known ELECTED PROSECUTOR EVER in the state of Washington to be charged while in office? And he gets off?? People in this county need to step up now to get rid of this guy. I fully agree with that in most cases but not when one is in an enormous position of power like Hagarty. He decides who gets charged with crimes and if he wants to ask for life in prison or death. He isn&amp;#039;t you or me. He&amp;#039;s the top law enforcement official of this county. He has an example to set. I can guarantee that he doesn&amp;#039;t offer all first time offenders charged with DUI a reduced charge so how is that fair?      But I do have to say I&amp;#039;m not surprised with all of the good ol&amp;#039; boys around here that he got off. Shame on Hagarty and shame on those out there that think this is a good outcome. Does he even have to do treatment? I doubt it. No wonder we have such utter lawlessness in this community. It&amp;#039;s embarrassing. It&amp;#039;s truly sad. </description>

<description>Does it matter since Hagarty allegedly caused the accident and then caused Mr. Montes to hit a a van in front of him according to the reports?  Are we going to see if that driver might not be legal, too?  Mr. Montes had braces on his daughter&amp;#039;s teeth!  Say what you want but this is a decent man that cares about his kids!  He had a well kept, clean home.  He wasn&amp;#039;t drinking.  He actually spoke decent enough English to respond to  questions (even though the cops said he didn&amp;#039;t speak English - strange)  and more importantly call 911 when he got hit and the other driver refused to do so.  And I doubt he even told many people, certainly not news folks until THEY CONTACTED HIM.  Don&amp;#039;t confuse the issues.  Hagarty is the one accused of thwarting the law.  How can a person who is entrusted, by swearing to God no less to uphold the law get a pass for breaking it WHILE HE IS IN OFFICE??  I realize that a lot of folks in this town have been stopped for drinking and driving and the natural reaction is to give him some leeway but the difference is HE is the one who calls the shots on the prosecution of  ALL CRIMES IN THIS COUNTY.   If he has a substance abuse problem do you really want him making those important calls?  And if he doesn&amp;#039;t or claims not to then doesn&amp;#039;t that imply he has very poor judgement?  It&amp;#039;s a no win situation.  He needs to resign. </description>

<description>I wholeheartedly agree.  I was outraged at the way he treated Mr. Montes.   I would again say that I think authorities should consider felony charges because of the accident. The man had to go to the hospital two (2) times so far!  Why isn&amp;#039;t Hagarty being charged with vehicular assault or second degree assault??.  The police reports say Hagarty caused an accident involving three vehicles, not just Mr. Montes&amp;#039; vehicle.  Has this happened before with him?  Why did he resign from being the Klickitat Co. Prosecutor in 2001?  Just seems odd to resign after running for election if there wasn&amp;#039;t some kind of controversy. </description>

<description>I would like to see KIMA and the other news organizations request the video from the trooper&amp;#039;s vehicle.  My understanding is that it is standard procedure for it to be on from the time they are dispatched to the scene to the end of the contact with the suspect.   This would include what was going on in the vehicle and whatever conversations took place between law enforcement and the suspect Hagarty.  Since there are so many people wondering if he was treated any differently from the average DUI suspect, this would certainly answer that question.  But wouldn&amp;#039;t it be funny if for some reason they neglected to turn it on?  Hope that isn&amp;#039;t the case. </description>

I remember the paper reported a while ago when there was an allegation of conflict of interest involving a rape case that Hagarty had a cop living with him. <description>All the time wasted while they drove him to Union Gap and then to County was no doubt helping lower the end result of his BAC.  I have a hard time believing they didn&amp;#039;t know there was an issue with the machine before having to make the detour.  Outrageous.  This is the stuff that makes the public distrust law enforcement. </description>

<description>Has Hagarty EVER been arrested for a drunken driving related offense prior to this one?  Or any illegal offense? He needs to answer those questions.  The public has a right to know if this was not his first brush with the law. <description>How is he owning up to it?  Is he pleading guilty at his arraignment - whenever that is?  I&amp;#039;d like to see him do that and then resign.  But he&amp;#039;ll probably either delay the process or get a deferred prosecution.  Did you see how mangled his fender was?  It didn&amp;#039;t appear that he merely tapped the other car.  Thank goodness the victim or victims didn&amp;#039;t have to be sent to the hospital or worse. </description>

<description>Why not ask his deputy prosecutors how often he goes drinking after work?  You think any one of them would claim it&amp;#039;s a rare occurrence?  Is that a good example to set for the public?  Why is it that you never saw Jeff Sullivan or Ron Zirkle getting arrested in their long tenures as prosecutor?  Is it because they cared about maintaining a modicum of decorum and understood what integrity means?  Has there ever been ANY prosecutor in this entire state that stayed in office after getting a DUI involving a car crash?  Not that I&amp;#039;m aware of.  But I guess Mr. Hagarty thinks he&amp;#039;s exceptional.  He can still do his job and prosecute people for doing the same thing he&amp;#039;s accused of without having ethical issues.  Multitasking?  Wow .  What a guy.  Let&amp;#039;s give him an award. </description>

<description>The difference here though is that you didn&amp;#039;t violate the public trust with what you did because you were not an elected official put into office to hold people accountable for violating the law. It isn&amp;#039;t right for him to remain in office with control over other people that are being prosecuted. It&amp;#039;s just plain wrong. <description>I took his statement to mean his personal issues involved his problem with alcohol although I suppose it could mean something else since it appeared to be purposefully vague.  But I have to correct you on the other point as far as claiming he gets off at 5pm and the crash was at 7pm..  He&amp;#039;s an elected official.  He&amp;#039;s always on the clock and I don&amp;#039;t think any elected official would tell you otherwise.  He doesn&amp;#039;t get a pass because his DUI car crash happened after the office closed.  It&amp;#039;s an honor to be elected and to serve the people of this county.  It&amp;#039;s an honor he clearly does not deserve to hold any longer.  The man needs to resign. </description>

<description>The BAC results should be listed on the ticket (because, in part,  that determines the potential penalties) and it will be filed in district court, therefore, public record.  He can&amp;#039;t keep it secret for long.  But what I want to know is what about the accident he caused?  Will he be charged with a felony?  He hit another person with his car while drunk.  He could be charged with second degree assault under the theory that his vehicle was a deadly weapon.  He could also potentially be charged with vehicular assault if the person or persons in the car he hit were hurt and it&amp;#039;s considered substantial bodily harm.  The cops reported there were no injuries at the time but who&amp;#039;s to say the  victims didn&amp;#039;t get soft tissue injuries?  I sure hope that the attorney general or whomever the county gets to prosecute him considers all of the potential charges. </description>

And as a taxpayer and long standing citizen of this county I expect a lot more from elected officials than being pulled over on public roadways on suspicion of DUI and HITTING ANOTHER CAR.  He isn&amp;#039;t your average county resident.  He is one of the most powerful men in the county capable of asking to put people to death or lock them up for their entire lifetimes.  Is it too much to ask that you do that job sober????  Come on. </description>
