Also, what we have here is a major push to regulate health care because it has allegedly become too expensive for some. If you accept the premise, there's nothing illogical or inconsistent about wanting to keep the "reform" simple and attack a large root cause. Runaway litigation costs are a large root cause that would be very easy to eliminate through tort reform. Perhaps it's not optimal -- but it's a hell of a lot more optimal than what this Congress is proposing.

So here's the deal. States like Texas have imposed tort-reform measures. In Texas, these measures include caps on non-economic damages like pain and suffering, etc. Not surprisingly, Texas has enjoyed an increasing number of top-notch health-care practitioners. So while the trial lawyers have definitely taken a hit, Texans in general have got access to some really great health care. Shouldn't the rest of the country follow Texas's lead? Instead, we get this apparent turd of a bill. Can Texas secede yet? Yes we can!
