No blight finding was required, because in that case the legislature had granted special authorization in separate legislation.  </description>

<description>I was simply wondering if the State was involved in these negotiations or EDGE simply believed it had the power of Eminent Domain which I believe is highly questionable. If a chip plant was going to be coming here I would think the State would be involved not EDGE. Where does EDGE get the power of Eminent Domain?  </description>

<description>The NY Constitution contains two Articles dealing with the grant of the power of Eminent Domain to an entity other than the State of New York. Article IX Section (1)(e) grants the State Power of Eminent Domain to local governments and Article XVIII grants such power to public corporations for the limited purpose of Housing under the grant of authority of the Federal Urban Renewal Statutes, the Federal Housing Act of 1949 and its progeny. Otherwise as stated in the NY Eminent Domain Procedure Law &amp;sect; 101, such law provides the exclusive procedure by which property is acquired by exercise of the power of eminent domain in New York State. How then does the state legislature authorize EDGE or any other public corporation to exercise this power of eminent domain aside from Article XVIII of the State Constitution? If the State of New York wanted to place a chip plant in Marcy, New York it would condemn the necessary property under the State&amp;rsquo;s Eminent Domain Law. The State&amp;rsquo;s Constitution does not grant this power to any public corporation (authority) for any other purpose, any state statute to the contrary notwithstanding. The fact that the State is not condemning any property for use as a chip plant hardly speaks well of its future.  </description>
