I forgot to add this to my previous post, the man who killed my son, hit and ran. He drove off down the country road and when the car gave out, he parked it in a field, took the registration, locked it up, and started walking. He never even checked on my son, left him lying there and didn't even give him the dignity a person whould give a dog if they had hit one. When he was found walking down that country road by police, he lied to them and told them his car had a flat tire and that is why he pulled it off into the field.

When we went to trial for his sentencing, our family was allowed to speak. When he was given his turn to say something to our grieving family, he refused and his lawyer apologized for him. When the judge asked him if he was responsible for this accident, all he said was "that's what they tell me".

Hi--I have a similar story. My son was also killed by a drunk driver, on Feb. 17th, 2005, also in Kosciusko County. The offender was originally sentenced to the max of 20 years, but after an appeal to the Indiana State Court of Appeals, his sentence was reduced. He ended up serving JUST 4 1/2 years. He was recently released (in August 2009).
The offender in my son's death was also a repeat offender, but the state decided that since his record wasn't fairly recent, that "he did not deserve the harshest sentence".
