The presumption of innocence, sometimes referred by the Latin Ei incumbit probatio qui dicit, non qui negat (the principle that one is considered innocent until proven guilty) is a legal right of the accused in a criminal trial, recognised in many nations. The burden of proof is thus on the prosecution, which has to collect and present enough compelling evidence to convince the trier of fact, who is restrained and ordered by law to consider only actual evidence and testimony that is legally admissible, and in most cases lawfully obtained, that the accused is guilty beyond a reasonable doubt. In case of remaining doubts, the accused is to be acquitted. This presumption is seen to stem from the Latin legal principle that ei incumbit probatio qui dicit, non qui negat (the burden of proof rests on who asserts, not on who denies).

The stupidity of the comments here amaze me!

Hard to believe that the American public is so ignorant, really, I'm not even going to bother making my point since it would be incomprehensible to the people commenting here!

The commissioner may want to use the federal laws in his defense.
Federal laws supersede state laws. http://bojack.org/2010/08/speak_into_my_lapel_gra...

Why would I bring the war into it?
Reasonable question to ask, here is the answer:
Because KATU is making the case against reckless "government" spending. KATU insists that something must be done about that!
KATU has a real problem with American citizens getting our "tax" money for things like health care and retirement.
But KATU and John Charles never ever bring up the big daddy of government misuse of our hard earned tax money, namely THE WAR AND DEFENSE BUDGET!
For some reason that huge waste of our taxes is acceptable, only attack actual citizens getting some use out of the tax funds.
It's biased, its unreasonable, and its propaganda, pure and simple.
KATU always has a right wing agenda and follows it to a T.
Support wars and war profiteering, but attacking labor unions and "big government" that employees citizens.
KATU is dishonest, devious, and darn out unreliable.
You will never get an objective report from KATU regarding TRIMET
