jaysays.com | because simon isn't cool anymore : Will Glee Get Away with Transphobic Remark? Yeah, Probably.

My apologies, Alex. My psychic powers failed me when writing this. Clearly, you guys did cover it, but well after this post was published, so I was unaware (but did "do" due diligence). My "demand for an apology" statement was more rhetorical. We go up in arms about so many things - but this one nearly slipped threw the cracks.

jaysays.com | because simon isn't cool anymore : When is a Hate Crime Not a Hate Crime? - When SAPD Investigates

It's not always a hate crime when a straight person kills a gay person, contrary to your statement. However, Cody (aka "CJ") confessed that he killed Troy because Troy "made a pass at him." It's a common claim of "Gay Panic" and constitutes a hate crime. 2% of sexual orientation based hate crimes in 2008 were committed due to heterosexual bias. None of which were murder. I won't get into the rest of your comment, but if you would like a referral to a psychiatrist, please feel free to email me via the contact page.

Andy: I\\\'m an LGBT blogger - not a prime time media outlet with editors at my disposal. My audience is mostly LGBT and/or fierce allies who are remarkably educated on issues within our community. I did not expect this piece to go as viral as it did. I\\\'m not the first to make the charge and I won\\\'t be the last. My faults as a writer, blogger, activist, advocate, etc do not in any way excuse this \\\"platform.\\\" Your accusation that I\\\'m grasping at straws doesn\\\'t change the fact that Lawrence was arrested along with his partner and the same could happen under a reinstatement of the sodomy laws. It doesn\\\'t change the fact that \\\"felony\\\" means prison time in Texas. It doesn\\\'t change the fact that I\\\'m a gay Texan and I will continue to fight for equality for LGBT people, immigrants, women and any group I see being targeted by our government - thus I\\\'m opposed to this platform.

Lawrence and his partner were put in prison overnight because of the Texas Sodomy Law (which targeted only homosexual sodomy). Felony offenses in Texas are a prison sentence as well. Not hype... fact. The title is accurate.

I'm going to post this within the main thread for clarification on the contentious points raised by many of you... thereafter, I'll leave you to your own dialogue. The comments claiming that the GOP Platform does not support the imprisonment of gays are wrong. It, in fact, DOES. To show that, a little knowledge of the history of the Texas Sodomy Law is in order. I did not include that as part of this post, which was apparently a mistake. I made the erroneous assumption that readers would know the history of the highly publicized law. I forget that I'm older than many readers and would thus recall it much more clearly. In Texas, the Sodomy law was overturned by the Supreme Court in the case Lawrence v. Texas. Lawrence and his partner *spent a night in jail* upon being found in their home engaging in "sodomy." If that is not "imprisonment" I'm not sure what would qualify. The GOP platform linked to clearly calls for a reinstatement of the sodomy law - before repeal that law made it an offense to engage "in deviant sexual intercourse with another individual of the same sex," and was also known as the "Homosexual Conduct Law." It did not outlaw sodomy between opposite sex couples. Further, under Texas law, a felony is punishable (upon proof of guilt) with a prison sentence. Who would be tried (be they clergy or state/city employees) is moot in my opinion. Would it really make a difference who went to prison on FELONY charges for performing a ceremony honoring the love and commitment of two people? Please, take some time to educate yourself and know what is at stake - make your own decisions and draw your own opinions - then get out and VOTE, call your representatives and demand they publicly condemn this platform or stand united with it - at least then we will know where they stand. YES WE CAN STARTS WITH YES WE DO!

Hi Golden: The platform area of the TexasGOP website has not been updated since 2009. You can Google "2010 Texas GOP Convention" and find links about the convention held last weekend, the platform presented and various the issues contained in the platform. There are sources such as Fox News and other "reputable" news sources (if I can use that word to describe media these days). I certainly appreciate the skepticism. It's important that we look into all facts available. The Texas Democratic Convention is coming up soon and will be in Corpus Christi. I do hope that they platform committee does a much better job representing all people and freedom than this platform has done.

You are right that it wouldn't make it past the courts - assuming the call to keep funds from the RNC for Texas isn't a measure for succession. As to the misleading title, please note that a felony offense in Texas is punishable by a prison term. Reinstatement of the sodomy laws could hold a prison sentence as well. The platform clearly states that performing a marriage ceremony or issuing a marriage license to a same-sex couple would be a felony offense. It further illustrates support for reinstating the sodomy laws. Of note is the fact that the U.S. Supreme Court repealed sodomy laws after charges of sodomy against a couple in Houston, Texas - after police found them engaging in sodomy in their home (not in public). The case is Lawrence v. Texas and is a very interesting read if you aren't already familiar with the case.

jaysays.com | because simon isn't cool anymore : Morning Show's Transphobic Remarks Should Spark Outrage from the LGBT Community

You are absolutely right that the statement was inappropriate, even as a quip. I stereotyped Nascar fans and that was improper under even the most liberal of tests. It's certainly further evidence that we are all hypocrites in some form. But since I invoked Walt Whitman in the post, I'll take the liberty of invoking him again here: "Do I contradict myself? Very well then, I contradict myself. I am large, I contain multitudes."

jaysays.com | because simon isn't cool anymore : Anti-Gay, Anti-Worker Hyatt Gets Support from HRC San Antonio Chapter

Thanks Dan. Hyatt Corporate does have a great score from the HRC. I'm of the opinion that their lack of condemnation of money's donated in the Hyatt name (Manchester's Grand Hyatt) for Proposition 8 should take significantly from that 100% mark. Regardless of the "anti-gay" issue, a clear line was drawn because of the union-busting tactics and I'm shocked that the venue isn't being changed. An error, I can understand, but once it had clearly been pointed out to them some time ago, I would have hoped they would seriously reconsider. When they did not, it's a problem. Perhaps they can give some of the money they raise to the worker's union in retribution for their sin. HRC has long been accused of being an elitist organization with high-priced fund raisers putting it out of touch with the non-economically well-off LGBT people (the workers that are boycotting, for example). I can't count how many people have told me that they volunteer for HRC events because they can't afford to go to the events otherwise. This is a real problem within the organization and in many ways, booking the Grand Hyatt seems to be a slap in the face to those that otherwise want to help and be involved (but cannot financially afford to do so). We have an amazing resource available that HRC is not tapping - our people. They are ready, they are willing and they are looking for leadership - too bad they can't afford it. I do hope HRC San Antonio will reconsider its choice of venue, but that's probably like spitting in the wind considering they're already lining up to defend the decision.

jaysays.com | because simon isn't cool anymore : Fundraising 101 - Gay, Inc. Uses Grassroots Momentum but Not Its Power.

It's been a spitting match since the days of ACT UP, perhaps even longer but I'm not old enough to render a first hand perception on much of it. As to why we can't unite, that's the multi-million dollar question. What do we use to unite us? ENDA? DADT? DOMA? Direct Action? Indirect Action? Lobbying? Race? Religion? Our community is too large and contains multitudes. We've spent our lives being criticized and therefore don't take criticism well. This post is an observation that, while "we" scream at Republicans for their fundraising tactics, we use the same tactics. But it's also observing that Gay, Inc. (which isn't a term I particularly like, but certainly has its place) isn't using the grassroots momentum to its best advantage. We let our observations and criticisms divide us, but should we not make them? That being said, the grassroots groups can't come to the table with clean hands either. Some very nasty things are being said, more than just criticism.

The New Civil Rights Movement : Facebook Or Hate Book?

I think these groups serve a very important purpose. They illustrate, unequivocally, that the arguments against equal rights are not based upon logic, human compassion, reasoning or the law as Maggie Gallagher and her cohorts of hate try to appear in the media. Rather, they are rooted in evil, inspiring the murder and imprisonment of innocent people.
