This is merely a deliberate obfuscation of the truth in an attempt to create confusion. Confusion is the statist’s tool to make sure that people think they have insufficient intelligence to read a simple document and interpret what it means. Obviously he is positioning himself for a run at a political office as a democrat. He'll win the nomination by a landslide. This is what the left is looking for, as evidenced by the occupant of the White House.

Based on not reading this story, just what I imagined it says (which would make me an ideal candidate for Odumbo to appoint to some cabinet position) I say that Kagan has not yet read the Constitution and that is what makes her a shoe-in for the SCOTUS.
